CBP CROSS Rulings
CBP issues binding advance rulings in connection with the importation of merchandise into the United States. They issue the rulings to give the trade community transparency of how CBP will treat a prospective import or carrier transaction. Common rulings include the tariff classification, country of origin, or free trade agreement applicability of merchandise, among other things. These rulings are available in CBP's Customs Rulings Online Search System (CROSS) database.
The International Trade Administration has published a "Timken"1 notice stating that a recent Court of International Trade's ruling is not in harmony with the ITA's final results of AD duty administrative review for helical spring lock washers from China, for the review period October 1, 2002 through September 30, 2003, with respect to Hangzhou Spring Washer Co., Ltd. (Hangzhou).
In the November 29, 2006 issue of the U.S. Customs and Border Protection Bulletin (CBP Bulletin) (Vol. 40, No. 49), CBP issued a notice announcing its receipt of a "Lever-Rule" application on behalf of American Standard International, Inc. concerning certain "Spin-On Air Dryer Desiccant Cartridges."
Shippers NewsWire reports that the Census Bureau and U.S. Customs and Border Protection (CBP) are engaging in talks aimed at finalizing the rules for mandatory electronic filing of export information (i.e., mandatory Automated Export System (AES) filing). The article notes that in February 2006, DHS and CBP threatened to hold the mandatory AES regulations unless Census changed language pertaining to post-departure filing of export information (i.e., Option 4) and gave DHS and CBP the right to share U.S. export information with other governments and federal agencies. The U.S. is preparing to implement hundreds of tariff changes in the 2007 U.S. Harmonized Tariff Schedule (HTS) in order to conform U.S. law to international Harmonized System (HS) nomenclature changes recommended for adoption by the World Customs Organization (WCO), and to certain Harmonized System Committee (HSC) decisions necessary to ensure uniform application of the nomenclature, etc.
The International Trade Commission (ITC) has issued a limited exclusion order (order) against Sinochem Ningbo, Ltd. (Sinochem) of Ningbo, China in its section 337 patent-based investigation of certain portable power stations and packaging therefor.
U.S. Customs and Border Protection (CBP) has posted to its Web site Amendment 4 (December 2006) to the Customs Automated Manifest Interface Requirements (CAMIR) for air (CAMIR-Air).
According to U.S. Customs and Border Protection (CBP) officials and press reports, 100 trade and textile enforcement employees from the Office of Field Operations (OFO) will transfer to the new Office of International Trade (OT, previously the Office of Strategic Trade), effective December 24, 2006.
CBP has issued an ABI administrative message stating that the port of Chicago offered limited services on December 1, 2006 due to inclement weather. CBP states that it is granting all filers filing entry on December 1 a snow day. Shippers' NewsWire reports that on December 1, 2006, U.S. Customs and Border Protection (CBP) is scheduled to electronically distribute to thousands of companies a survey on the Customs-Trade Partnership Against Terrorism (C-TPAT).
