Harmonized Tariff Schedule

The Harmonized Tariff Schedule (HTS) provide classification provisions and duty rates for almost every item that exists. It is a system of classifying and taxing all goods imported into the United States. The HTS is based on the international Harmonized System, which is a global standard for naming and describing trade products, and consists of a hierarchical structure that assigns a specific code and rate to each type of merchandise for duty, quota, and statistical purposes. The HTS was made effective on January 1, 1989, replacing the former Tariff Schedules of the United States. It is maintained by the U.S. International Trade Commission, but CBP is responsible for interpreting and enforcing the HTS.

Search Primer

Exporter Contests Commerce's Remand Picks for Surrogate Values of Ocean Freight, Fabricated Inputs

Exporter Zhejiang Dingli Machinery challenged the Commerce Department's decisions made on remand to use Maersk data to value ocean freight and value minor fabricated components using Harmonized Tariff Schedule subheading 8431.20.90 data. Filing a response to the agency's remand results in a case on the antidumping duty investigation on mobile access equipment from China, Dingli said the Maersk price quotes are unreliable and that the agency strayed from its normal practice in picking the data for subheading 8431.20.90 (Coalition of American Manufacturers of Mobile Access Equipment v. United States, CIT # 22-00152).

CIT Reinstates Warby Parker's Suit on Section 301 Exclusions for Glasses Frames, Lenses

The Court of International Trade set aside its previous dismissal for lack of prosecution of importer Warby Parker's case on the applicability of Section 301 exclusions to its glasses frames and lenses. Judge Timothy Reif agreed to restore the case to the customs case management calendar and extend the time for the case to remain on the calendar for another six months (Warby Parker v. United States, CIT # 23-00042).

SCOTUS Will Hear Cases on IEEPA Tariffs, Sets Argument for Early November

The Supreme Court on Sept. 9 agreed to hear two cases on the legality of tariffs imposed under the International Emergency Economic Powers Act and to do so on an expedited basis. The court set a briefing schedule that would conclude by Oct. 30 and set argument for the first week of November (Donald J. Trump v. V.O.S. Selections, U.S. 25-250) (Learning Resources v. Donald J. Trump, U.S. 24-1287).
