Harmonized Tariff Schedule

The Harmonized Tariff Schedule (HTS) provide classification provisions and duty rates for almost every item that exists. It is a system of classifying and taxing all goods imported into the United States. The HTS is based on the international Harmonized System, which is a global standard for naming and describing trade products, and consists of a hierarchical structure that assigns a specific code and rate to each type of merchandise for duty, quota, and statistical purposes. The HTS was made effective on January 1, 1989, replacing the former Tariff Schedules of the United States. It is maintained by the U.S. International Trade Commission, but CBP is responsible for interpreting and enforcing the HTS.

Clear Terms

Search Primer

Term list: Separate terms with spaces, not commas or semicolons.

US and Piling Importer Settle 2023 Case

The U.S. and importer Marubeni-Itochu Steel America jointly stipulated settlement terms for the importer’s classification case June 20. They agreed that the epoxy resin used as a coating for some of Marubeni-Itochu’s products, pilings for a wall system, should be included in the valuation of products classified under Harmonized Tariff Schedule heading 7301 rather than heading 7308 (Marubeni-Itochu Steel America Inc. v. United States, CIT # 23-00149).

Importer Says US Creating Section 301 Exclusion Rule for Goods From FTZs

Responding to a U.S. cross-motion for judgment in its classification dispute, computer parts importer Atlas Power said the government was trying to raise a new argument that none of Atlas’ entries in question were eligible for a Section 301 tariff exclusion because they were entered under a privileged status into a foreign-trade zone (Atlas Power LLC v. United States, CIT # 23-00084).

SCOTUS Denies Importers' Bid to Expedite Consideration of Cert Petition in IEEPA Suit

The Supreme Court on June 20 denied a motion from importers Learning Resources and Hand2Mind to expedite consideration of their petition to have the high court take up their lawsuit against tariffs imposed under the International Emergency Economic Powers Act (Learning Resources v. Trump, Sup. Ct. # 24-1287).

CBP Refunds 2.5% Duties Paid on Rare Cars, Classifying Them as Collector's Pieces

An individual importer, Ricardo Vega, will receive refunds for a Porsche imported in 2023, according to a stipulated judgment filed at the Court of International Trade on June 17. Similarly, importers Yellowbird Enterprises and Vantage Point Services will receive refunds for duties paid on a Jaguar also entered in 2023.

US Tells SCOTUS No Need to Consider Cert Petition on Expedited Basis

U.S. Solicitor General John Sauer urged the Supreme Court to reject two importers' bid to have the high court hear their case on whether the International Emergency Economic Powers Act provides for tariffs on an expedited basis. Sauer said the importers, Learning Resources and Hand2Mind, haven't justified "such a stark departure from established practice," which would see the Supreme Court take up the case prior to the U.S. Court of Appeal for the D.C. Circuit weighing in (Learning Resources v. Trump, Sup. Ct. # 24-1287).
