Harmonized Tariff Schedule

The Harmonized Tariff Schedule (HTS) provide classification provisions and duty rates for almost every item that exists. It is a system of classifying and taxing all goods imported into the United States. The HTS is based on the international Harmonized System, which is a global standard for naming and describing trade products, and consists of a hierarchical structure that assigns a specific code and rate to each type of merchandise for duty, quota, and statistical purposes. The HTS was made effective on January 1, 1989, replacing the former Tariff Schedules of the United States. It is maintained by the U.S. International Trade Commission, but CBP is responsible for interpreting and enforcing the HTS.

The Commerce Department improperly used the financial statements of Indonesian company PT Suparma in the antidumping duty investigation on paper plates from Vietnam, respondent Go-Pak Vietnam argued in a May 17 complaint at the Court of International Trade. The respondent also challenged Commerce's decision to use a simple average of the average unit values from two different subheadings to value its paper input, despite evidence showing that the company's paper is classified under only one of the subheadings (Go-Pak Paper Products Vietnam Co. v. United States, CIT # 25-00070).

Temporary-Use Tires From China Not Subject to AD/CVD on Passenger Car and Light Truck Tires

In a scope ruling released May 7, the Commerce Department said that certain temporary use spare tires imported from China by Logistical Resource Development aren’t subject to antidumping and countervailing duty orders on Chinese passenger vehicle and light truck tires. It has reached similar decisions regarding temporary use tires from Taiwan and Thailand (see 2403120022) and 2401250038).

Trade Court Says Product 'Imported' When Admitted to FTZ for Drawback Purposes

A product is "imported" for duty drawback purposes when it's admitted into a foreign-trade zone and not when entered for domestic consumption, the Court of International Trade held on May 15. Judge Timothy Reif said the definition of "importation" found in both the dictionary and Supreme Court precedent distinguishes importation from entry.
