Harmonized Tariff Schedule

The Harmonized Tariff Schedule (HTS) provide classification provisions and duty rates for almost every item that exists. It is a system of classifying and taxing all goods imported into the United States. The HTS is based on the international Harmonized System, which is a global standard for naming and describing trade products, and consists of a hierarchical structure that assigns a specific code and rate to each type of merchandise for duty, quota, and statistical purposes. The HTS was made effective on January 1, 1989, replacing the former Tariff Schedules of the United States. It is maintained by the U.S. International Trade Commission, but CBP is responsible for interpreting and enforcing the HTS.

Search Primer

Term list: Separate terms with spaces, not commas or semicolons.

Multi-word term: Place inside quotes to ensure an exact match (e.g. "China import").

Acronyms: Use all capital letters to ensure the search is not looking for that letter sequence instead.

Commerce Ignored Cut-Off Date for Assessing Subsidies From Russian Government, Exporter Says

The Commerce Department unlawfully chose to break with its past practice of not considering subsidies provided by the Russian government prior to April 1, 2002, in a countervailing duty review on phosphate fertilizers, respondent JSC Apatit argued. Filing a complaint at the Court of International Trade on Jan. 9, Apatit argued that Commerce failed to apply this cut-off date when analyzing whether mining rights were provided to the company for less than adequate remuneration in the 2022 review of the CVD order (Joint Stock Company Apatit v. United States, CIT # 24-00226).

Importer Gets First Sale Valuation for Mixed Oxide Products at CIT

CBP will liquidate importer Neo Chemicals & Oxides' mixed oxide products using a "first sale" transaction valuation method, the government and importer said in a stipulated judgment. Submitting the stipulation to the Court of International Trade on Jan. 6, the parties said the company's entries "will be appraised under the transaction value method based on the prices the middleman paid to the manufacturer." Neo brought the suit in 2021 seeking first sale valuation of its goods classifiable under Harmonized Tariff Schedule headings 3815 and 2846 (see 2108190065) (Neo Chemicals & Oxides v. United States, CIT # 21-00453).

3D Pen Importer Seeks to Compel Discovery After US Claims Deliberative Process Privilege

3D importer Quantified Operations on Jan. 5 asked the Court of International Trade to compel discovery in its classification case. The importer said the government was trying to hide behind the deliberative process privilege without meeting the procedural requirements for it (Quantified Operations Limited v. U.S., CIT Consol. # 22-00178).
