Proceedings in a Court of International Trade case involving a first sale valuation for imports from a non-market economy will continue as planned and won't await a ruling from the U.S. Court of Appeals for the Federal Circuit on a related case, Judge Mark Barnett said in a June 3 order denying a stay sought by apparel importer Imperia Trading. It argued that proceedings should be halted since the Department of Justice “relies heavily” on a March 1 CIT decision involving the first sale treatment of cookware imported by Meyer (see 2103020040). Barnett sided with DOJ, saying that "the court is not persuaded that the outcome of the appeal in Meyer Corp. ... will necessarily be determinative in this case." Imperia now faces a June 4 deadline to submit a motion for summary judgment barring an extension (Imperia Trading, Inc. v. United States, CIT #15-00142).
The Department of Justice is debating with Chinese cabinet exporter Delian Meisen Woodworking Co. over whether the Commerce Department can construe false advertising materials as grounds to apply adverse facts available in antidumping proceedings. In an April 5 revised response revised again on May 26, DOJ argued that Meisen's inability to explain a discrepancy between its U.S. sales price and factors of production information resulting from false advertising lawfully led to Commerce applying AFA. Meisen in its corrected reply is fighting to establish that Commerce's antidumping investigations must be limited to the actual factors of production used to make the subject merchandise, lest AD proceedings be used to “take responsibility for enforcing a wide variety of U.S. laws and unfair business practices under the antidumping laws” (Dalian Meisen Woodworking Co., Ltd. v. United States, CIT #20-00109).
The Department of Justice wants a stay in a case involving the Commerce Department's use of its non-market economy policy, arguing that issues in a related appeals court case have implications for the case in the Court of International Trade. In a May 25 motion, DOJ argued that since the Federal Circuit case, China Manufacturers Alliance, LLC v. United States, Fed. Cir. #2020-1159, deals with whether the statute authorizes Commerce to apply a China-wide rate to an exporter that failed to show freedom from government control in an antidumping investigation, the outcome of the case will "likely impact the outcome of this remand" (Jilin Forest Industry Jinqiao Flooring Group Co., Ltd., v. United States, CIT #18-00191). In the CIT case, the court remanded an antidumping investigation on multilayered wood flooring, finding that the agency's determination that Chinese exporter Jilin Forest Industry Jinqiao Flooring Group was de facto controlled by the Chinese government lacked substantial evidence (see 2104300079). The decision took issue with Commerce's application of the China-wide rate to Jilin, given that Commerce's NME policy was meant to incentivize greater compliance and Jilin fully complied with all Commerce requests.
The Commerce Department failed to substantiate the quantity of fish meal and fish oil byproducts when granting a byproduct offset in a remand of an antidumping case, the defendant intervenor, the Catfish Farmers of America, argued in the Court of International Trade. Opposing remand results in a May 11 filing in CIT, CFA said Commerce's decision to flip its byproduct offset ruling on plaintiff NTSF Seafoods Joint Stock Co.'s fish meal and fish oil products was contrary to agency practice and the law. The decision to grant the offset failed to “substantiate” byproduct production and used “unreasonable surrogates to value NTSF's fish meal and oil by-product offsets,” CFA argued. NTSF agreed with the remand results in its own comments.
The Court of International Trade remanded an antidumping case to the Commerce Department, finding that the agency's determination that wood flooring importer Jilin Forest Industry Jinqiao Flooring Group Co. was de facto controlled by the Chinese government lacked substantial evidence. Judge Richard Eaton, in the April 29 opinion, also found that Commerce's application of its non-market economy policy to Jilin did not clear the proper evidentiary standard, launching into an elongated discussion of the policy's original intent.
A company must be able to prove that prices weren't distorted for transactions involving non-market economies (NMEs) when claiming first sale treatment, the Department of Justice said in an April 29 Court of International Trade filing (Imperia Trading, Inc. v. U.S., CIT # 15-00142). DOJ's argument relies on a recent CIT decision involving imported Meyer cookware that said the involvement of Chinese companies made it difficult to determine whether a transaction is affected by non-market influence (see 2104200075). DOJ made the filing as part of a dispute over whether Imperia Trading, an importer of apparel made in China, can use the sale from a Hong Kong middleman company for appraisement.
The Court of International Trade issued two opinions in antidumping and countervailing duty cases late on April 29. In one opinion, CIT sustained Commerce's second remand results for the 2016 countervailing duty administrative review on corrosion-resistant steel products from India, finding that the agency properly applied total adverse facts available when determining the duty rate for Indian exporter Uttam Galva Steels Limited.
The Department of Justice and defendant-intervenor American Kitchen Cabinet Alliance moved to strike part of Chinese cabinet exporter's argument in an antidumping case, claiming the exporter included a new argument in a court filing that was not part of the underlying investigation. In dual April 22 motions to strike in the Court of International Trade, both DOJ and the AKCA said the argument by the exporter, The Ancientree Cabinet Co., over the proper classification of its inputs for wooden cabinets and vanities in selecting surrogate values for an antidumping investigation from a nonmarket economy was not raised during oral argument. A lawyer associated with the case confirmed Ancientree will file a response to the motion to strike.
