CIT Declines to Stay IEEPA Tariff Suit Pending Resolution of Fellow Cases
The Court of International Trade on May 15 denied the government's bid to stay one of the major challenges to trade action taken under the International Emergency Economic Powers Act pending resolution of earlier-filed cases challenging the tariff action. Judges Jane Restani, Gary Katzmann and Timothy Reif, who now preside over all major cases challenging IEEPA tariffs at the trade court (see 2505150009), concurrently granted a motion from the plaintiffs, represented by the libertarian group Pacific Legal Foundation, to expedite consideration of the case (Princess Awesome v CBP, CIT # 25-00078).

The text-only order instructed the foundation to re-file their motion for summary judgment in a form that complies with the court's rules no later than May 19. The order also told the government to file a reply by May 23 and that a reply from the plaintiffs is expected no later than May 30.
The Pacific Legal Foundation brought its suit on behalf of 11 importers to challenge President Donald Trump's reciprocal IEEPA tariffs and tariffs on China (see 2504250038). The government had sought to stay the case pending resolution of a case brought by 12 U.S. states against all IEEPA tariff action taken under Trump.
