Ninestar Says It's Prepping UFLPA Delisting Petition, Argues Against Stay at CIT
Chinese exporter Ninestar Corp. will submit a delisting petition with the Forced Labor Enforcement Task Force to get off the Uyghur Forced Labor Prevention Act Entity List, the company told the Court of International Trade in an April 12 status report (Ninestar Corp. v. United States, CIT # 23-00182).
Ninestar told the court that it's "working on that petition expeditiously," though it said it "would be premature to stay the litigation," noting that the government's oppositions should "be placed back on the calendar."
The exporter said the oppositions will allow the court to quickly rule on them following the delisting petition being filed and that the briefs "will elaborate on the Government's views of the facts and law supporting FLETF's original listing decision, seeing those oppositions will assist Ninestar’s counsel in preparing a more focused and hopefully effective delisting petition."
As a result of the exporter's plea, Judge Gary Katzmann in a text-only order instructed the government to respond to the status report and offer its "views on the timing of outstanding motions before the court by Wednesday, April 17, 2024." Previously in the case, the judge rejected the exporter's motion for a preliminary injunction against designation on the Entity List (see 2402290081).
