N350489: The tariff classification of a captive air training dummy missile body from the United Kingdom

HTS: 7616.99.5190, 9903.85.14; 9903.01.25, 2.5% + 25% + 10%, “Other articles of aluminum: Other: Other: Other: Other: Other: Other.”
Item: The item under consideration is described as a dummy missile body for training purposes. After importation it will be used to test and validate the mechanical strength requirements of a missile launcher. At importation, the dummy missile body will not contain a warhead, rocket motor, electronics, measuring devices, or mechanical apparatus. In addition, the dummy missile’s body is not identical to the fully functional and complete version of the missile due to differences in design, structure, and therefore functionality. Consequently, the dummy missile body cannot be used as, or converted into, a part of a live, fully functional missile. The dummy missile body consists of 60% aluminum and 40% steel by weight.

N350577: The tariff classification of a plastic sterilizer bag from Vietnam

HTS: 3924.90.5650, 9903.01.25, 3.4% + 10%, “Tableware, kitchenware, other household articles and hygienic or toilet articles, of plastics: Other: Other. Other.”
Item: The item is a plastic sterilizer bag, which is an oval-shaped sterilizer bag with a flat bottom, made of silicone plastic, and features a foamed polypropylene (PP) plastic handle. The item measures approximately 8.7 inches high with the carry plastic handle up by 8.7 inches wide by 5.7 inches deep. The plastic sterilizer bag is reusable and includes a latch to seal it. It is specifically designed for microwave sterilization for steam cleaning of breast pump and baby bottle parts. The breast pump and baby bottle parts are not included. To use the sterilizer bag, the user adds two ounces of water, places the parts to be cleaned inside the bag, closes the latch, and puts the bag inside the microwave on high heat. When the bag is removed from the microwave, the user pours out the excess water and takes out the sanitized items.

Item: The product under consideration is described as the “GoMop.” It is constructed from aluminum, polyethylene plastic, and a microfiber material. The mop has a wringing feature on the handle that slides down over the mop head to squeeze out excess water.

Item: Style 1 is a women’s cardigan constructed from 80% polyester and 20% spandex knit fabric. The garment features a self-fabric two-ply constructed V-styled front and collar, a full front opening with a zippered closure, long sleeves with self-fabric cuffs, side entry pockets below the waist, a woven fabric label with the CHEROKEE ® trademark on the lower left-front panel, a back yoke, and a loose-fitting, self-fabric bottom band. Style 2 is a women’s bodysuit constructed from knit and woven components. Based on the submitted material, each container comprises a predominant lower portion and a detachable lid which features an impressed logo.

N350708: The country of origin of shrimp

Origin: Ecuador
Item: A scenario whereby Whiteleg Shrimp (Litopenaeus vannamei, formerly Penaeus vannamei) obtained from shrimp broodstock is harvested, beheaded, and frozen in Ecuador. The shrimp is then shipped to Vietnam to be thawed, peeled, cut, deveined, marinated with wine, corn starch and soybean oil, frozen, and packaged for exportation to the United States. The finished product that will be sold to the food service industry will be packed in a plastic bag with a net weight of five pounds.
Reason: The processing undertaken at the facility in Vietnam does not effect a substantial transformation. Accordingly, the whiteleg shrimp retains its initial country of origin status and is a product of Ecuador.

N350734: The tariff classification of blood glucose monitoring systems from various countries

HTS: 9027.89.4530, 9903.01.25; 9817.00.96, free, “Instruments and apparatus for physical or chemical analysis (for example, polarimeters, refractometers, spectrometers, gas or smoke analysis apparatus); instruments and apparatus for measuring or checking viscosity, porosity, expansion, surface tension or the like; instruments and apparatus for measuring or checking quantities of heat, sound or light (including exposure meters); microtomes; parts and accessories thereof: Other instruments and apparatus: Other: Other: Electrical: Chemical analysis instruments and apparatus.”
Item: Five models of blood glucose monitoring systems that measure blood glucose levels by analyzing the electrical current generated when a blood sample reacts with a chemical on the test strip. This electrical current is then converted into a glucose reading displayed on the meter. The systems include the meter, owner’s guide, carrying case, test strips, lancing device, lancets, and are produced in South Korea, Taiwan or the Philippines.
Reason: The essential character of the glucose meter kits when imported with the meter, manual, carrying case, lancets, lancing device and test strips, is imparted by the glucose meter. The systems are specifically designed for use by the handicapped for secondary classification purposes. Therefore, they satisfy the description set forth in Chapter 98, Subchapter XVII, U.S. Note 4(a), and secondary classification 9817.00.96, HTSUS, would apply.

Item: The first item under consideration is the ReliOn Premier Compact Kit, which is a blood glucose monitoring system designed for individuals managing diabetes. In operation, the meter utilizes test strips which are inserted into the meter. A small blood sample is applied to the test strip. The meter then uses a chemical reaction on the test strip to determine the glucose concentration in the blood sample before displaying on the screen. The system includes the meter, carrying case, owner’s guide, test strips, a lancing device, and lancets, and is produced in the Philippines. The second item under consideration is the Glucocard Shine Express Kit, which is a blood glucose monitoring system designed for individuals managing diabetes. In operation, the meter utilizes test strips which are inserted into the meter. A small blood sample is applied to the test strip. The meter then uses a chemical reaction on the test strip to determine the glucose concentration in the blood sample before displaying on the screen. This meter also contains 29 different voice prompts helping the user through meter set-up, testing and review of results in their choice of English or Spanish. The system includes the meter, carrying case, owner’s guide, test strips, a lancing device, lancets, and a control solution, and is produced in South Korea.
Reason: The essential character of the glucose meter kits when imported with the meter, manual, carrying case, lancets, lancing device and test strips, is imparted by the glucose meter. The systems are specifically designed for use by the handicapped for secondary classification purposes. Therefore, they satisfy the description set forth in Chapter 98, Subchapter XVII, U.S. Note 4(a), and secondary classification 9817.00.96, HTSUS, would apply.

N350781: The tariff classification of collapsible aluminum tubes from France

HTS: 7612.10.0000, 9903.01.25, 2.4% + 10%, “Aluminum casks, drums, cans, boxes and similar containers (including rigid or collapsible tubular containers), for any material (other than compressed or liquefied gas), of a capacity not exceeding 300 liters, whether or not lined or heat insulated, but not fitted with mechanical or thermal equipment: Collapsible tubular containers.”
Item: The items under consideration are described as empty collapsible aluminum tubes which will be used as packaging for different materials in the cosmetics, pharmaceuticals, food, household, and industrial sectors. The subject tubes are predominantly grade A7 aluminum cylinders with polymeric coatings and polypropylene plastic caps. One end of the tube is cylindrical and open, and the opposing end is formed into an open nozzle with M11 threading. During the final stages of production, the nozzles are sealed with a membrane and capped with a threaded polypropylene plastic cap.

The rate of duty will be free.”
Item: The first article under consideration is described as the Assista-Rail. It is a bed rail designed to facilitate the entry and exit from a bed. The bed rail is adjustable by 4” to accommodate taller mattress heights, supports up to 300 lbs., has a padded rail for comfort and versatile gripping of the surface, and does not incorporate floor supports. The tubular metal is made of alloy steel, and the finish is a powder coat (white). The second article under consideration is described as a Tub-Rail, which is a safety bar that is intended for moderate vertical load bearing to provide support in both getting in and out of the bathtub for people with reduced mobility. It is constructed of a U-shaped steel support rail that is 1-inch in diameter and 5.5 inches wide. The rail mounts to the side of a bathtub and features a stainless-steel screw that adjusts the Tub-Rail to fit a bathtub wall from 3 to 7 inches wide. It is designed to support individuals up to 300 pounds.
