Mattress Petitioners Object to Removal of Zinus CIT Case From Combined Appeal
Appellants and domestic mattress petitioners objected July 8 to a U.S. Court of Appeals for the Federal Circuit order to remove mattress importer Zinus’ own appeal from the combined appeal (see 2506250052) (PT. Zinus Global Indonesia v. United States, Fed. Cir. # 25-1674).

The petitioners, led by Brooklyn Bedding, and Zinus filed appeals after the Court of International Trade ruled on two classification disputes (see 2412200061 and 2506250052). CAFC said in a June 27 order that it appeared Zinus didn’t intend to prosecute its appeal and set a date to drop Zinus’ case from the appeal’s caption absent objection from any party.
The petitioners said that Zinus’ case had been consolidated with another they initially filed in 2021. Their appeal also touches on issues involved in that consolidated case, they said.
They also said that CIT made rulings for Zinus on a couple of issues in its case that negatively impacted the petitioners. They are seeking to appeal those rulings, too.
CAFC also said in its order that it would be redesignating Zinus a defendant-appellee. The petitioners said they deferred to the appeals court on that matter.
