Steel Pods Used in Importer's Warehouses Not Subject to AD/CVD on Chinese-Origin Steel Racks
Two models of steel pod from China and specifically imported by Ledvance are not covered by antidumping and countervailing duty orders on steel racks, the Commerce Department said in a Jan. 21 scope ruling. It said the products don’t have the requisite physical characteristics.

The ruling considered steel pods that “can be characterized as a horizontal and rectangular surface, which is supported off the ground with four legs” and that rise well above the level of that surface, it said. It explained that Ledvance uses the products in its own warehouses to store products on wood pallets.
In turn, the orders cover steel racks with certain specified measurements -- such as “vertical load bearing members” that are more than two inches wide, it said.
Commerce said the language of the orders, as well as a prior, similar scope ruling for a different importer, had been enough for it to reach its conclusion. It said that one of the pod models under consideration doesn’t fit the characteristics of steel racks because it doesn’t brace “other structural members” or connect “horizontal members to vertical members.” And the other model’s vertical load bearing members are less than two inches wide, it said.
