US Settles 2012 Classification Case Regarding Chemicals Used in Photography
Parties filed a stipulated judgment Jan. 3 for a 2012 case regarding imported light-sensitive materials used in photography (Tokyo Ohka Kogyo America v. United States, CIT # 12-00261).

The U.S. and the case’s plaintiff, Tokyo Ohka Kogyo America, said in the judgment they had agreed that the imports would be classified as “chemical preparations for photographic uses ... sensitizing emulsions” under Harmonized Tariff Schedule subheading 3707.10.00. The products had initially been classified by CBP under the subheading 3707.90.32, a basket category for photographic chemical preparations.
As a result of the settlement, the products’ antidumping duty rate dropped from 6.5% to 3%.
