Ruling: The AG Cuffill device is classified under subheading 9018.90.75, which provides for “Instruments and appliances used in medical, surgical, dental or veterinary sciences, including scintigraphic apparatus, other electro-medical apparatus and sight-testing instruments; parts and accessories thereof: Other instruments and appliances and parts and accessories thereof: Other: Electro-medical instruments and appliances and parts and accessories thereof: Other: Other.” |
Issues: What is the proper classification of the subject AG Cuffill device under the Harmonized Tariff Schedule of the U.S.? |
Item: Medline Industries' AG Cuffill, a disposable, syringe-like device consisting of a graduated cylindrical barrel with a volume up to 10 cubic centimeters and a plunger. |
Reason: The AG Cuffill plays a key role in filling the cuff with a desired amount of air. Therefore, the AG Cuffill is classified in heading 9018, which covers the subject merchandise in its entirety. However, the question is whether the subject AG Cuffill is an “Electro-medical instrument and appliance” of subheading 9018.90.75. Drawing upon past cases, CBP determined that since the AG Cuffill operates via electricity from a battery, it constitutes an “electro-medical instrument and appliance.” Because the AG Cuffill is classifiable under subheading 9018.90.75, it is not classifiable under the residual provision of subheading 9018.90.80. |
