Settlement of Steel Tariff Exclusions Case Still Ongoing, US and Importer Say

The U.S. and steel importer AM/NS Calvert announced in a joint report April 12 that they are still in the process of seeking settlement in a case regarding the Commerce Department’s denial of the importer’s Section 232 tariff exclusion requests (AM/NS Calvert v. U.S., CIT # 21-00005).

In February, the two parties declared that they had reached an agreement in principle to settle, but that the U.S. had to first review Calvert’s import data. In their brief submitted April 12, the deadline the Court of International Trade had set for an update, they said Calvert “is presently revising certain data it first submitted so that the United States can vet eligibility and administrability.”

Once that process is complete, they said, DOJ and Commerce “expect to be able to recommend settlement.”

The case is one of three contesting rejections of steel tariff exclusion requests that the government attempted to get dismissed. The trade court rejected the dismissal motions in September 2023 (see 2309070037).
