In a Thursday order, Chief Administrative Law Judge Nolan Moser sought responses to Lumen’s motion by Oct. 5, with Lumen’s reply due Oct. 11. The ALJ set a possible schedule for the proceeding in which a hearing would occur Nov. 21-22 and the commission would reach a decision Dec. 20. The record doesn’t sufficiently support the Sept. 23 order, Lumen said in its hearing request: “In addition, there are significant issues as to whether the Order is lawful.”
