CBP Intends to Distribute FY21 AD/CV Revenues to Affected Domestic Producers

CBP intends to distribute assessed antidumping or countervailing duties for fiscal year 2021 under the Continued Dumping and Subsidy Offset Act of 2000 (CDSOA), it said in a notice. Certifications to obtain a continued dumping and subsidy offset under a particular AD/CV order or finding must be received by July 27.

CDSOA, known as the Byrd Amendment, requires that the revenues from AD/CV duties assessed on or after Oct. 1, 2000, be distributed on an annual basis to the affected domestic producers for specified qualifying expenditures. Although the Byrd Amendment has been repealed, all duties on entries of goods made and filed before Oct. 1, 2007, will still be distributed.

CBP lists the applicable AD and CV case names and numbers, subject product and country, and the names of the affected domestic producers associated with each order that are potentially eligible to receive a distribution. The document also provides instructions for affected domestic producers to file certifications to claim a distribution. CBP also posted the preliminary dollar amounts to help determine whether it would be worthwhile to file a certification in a given case. The final amounts available for disbursement may differ from the preliminary amounts.
