CIT Rules on Two AFA Challenges in AD Duty Cases
The Court of International Trade issued two decisions related to the application of adverse facts available in antidumping duty proceedings on solar cells from China and cold-rolled steel flat products from South Korea shipped through Vietnam.

In a May 5 ruling, CIT sustained Commerce’s rejection of a Vietnamese company’s quantity and value questionnaire in an antidumping duty circumvention inquiry related to cold-rolled steel flat products from South Korea.
On May 4, CIT sustained Commerce’s recalculation on remand of a Chinese solar cells exporter’s AD rate from the 2016-17 review, after finding Commerce had improperly applied partial AFA to the exporter based on an unaffiliated supplier’s lack of cooperation.
