CBP to Update ACE to Allow for Product Exemptions From Section 232 Tariffs

CBP will make changes to ACE Entry Summary "that will allow CBP to validate tariff rate adjustments and exclusions in support of Section 232 measures," the agency said in a CSMS message. The update will come on June 1, the date most of the country-wide exemptions to the tariffs on steel and aluminum are scheduled to end (see 1805040046).

When applicable, filers should include a product exclusion identifier in the "Importer’s Additional Declaration Detail," CBP said. Two additional Importer’s Additional Declaration type codes have been established, 02 for "Product Exclusion Information -- Steel products" and 03 for "Product Exclusion Information -- Aluminum products."

Starting June 1, "the Entry Summary Create/Update (AE) transaction will expect the inclusion of the relevant HTS chapter 99 applicable for the article (i.e., the tariff adjustment), except if the Importer has been granted a product exclusion, or if the country of origin has been exempted from the duty measures," CBP said. "Filers should report the additional 232 duty as well as the normal duty (if any) for the article. The determination of the relevant date to determine if a remedy is in effect can be found in the AE [CBP and Trade Automated Interface Requirements (CATAIR)] chapter’s ‘Duty Rate Date Matrix Hierarchy’ (in section ‘Basic Article Classification and Tariff Considerations’). The date is chosen from those reported (or those determined by CBP)."
