Extreme Linen, on the classification of bedding assortments in PVC storage bags. CBP classified the merchandise as a retail set under subheading 9404.90.85, dutiable at 12.8%. Extreme Linen says it should have been classified separately under subheadings 9404.90.85 (12.8%), 6303.92.20 (11.3%), 6304.93.00 (9.3%), 9404.90.20 (6%) and 3924.90.56 (3.4%). #17-00245. ​Appeals of CIT Decisions
The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of Oct. 2-8:
Gerson Company, challenging an Aug. 2 CIT decision that found its battery-operated candles with LED lights are classifiable in heading 9504 of the tariff schedule as lamps (see 1708030011). Gerson had argued the merchandise should have been classified in chapter 85 as LEDs or other electrical machinery. #18-1011. Opened Oct. 4.
U.S. government, challenging an Aug. 9 CIT decision that found legitimate Ford's use of tariff engineering to save on duties by adding stripped-down seats to a Ford Transit Connect cargo van and then removing them immediately after importation (see 1708170032). #18-1018. Opened Oct. 6.
