CBP Administrative Messages, Web Postings, Etc.

U.S. Customs and Border Protection (CBP) has posted to its Web site notices announcing the opening of the tariff-rate quotas (TRQs) on cotton and cotton card strips provided for under HTS Chapter 52, Additional U.S. Notes (AUSNs) 5 and 9, respectively, for the period September 20, 2006 through September 19, 2007. According to CBP, these TRQs open on September 20, 2006.

1. 2006/2007 Cotton & Cotton Card Strips TRQs Open September 20, 2006

The TRQ levels, the minimum access levels for specified countries, and the allocation for any country/area are also listed in these notices, as well as the related HTS Chapters 52 and 99 tariff numbers.

These notices also state that other than as provided for in the minimum access levels listed in these notices, articles that are the product of countries or areas who are not members of the World Trade Organization (WTO) shall not be permitted or included in the quantitative limitations set forth in these notices.

These notices further state that imports from Australia, Bahrain, Canada, Chile, El Salvador, Guatemala, Honduras, Jordan, Mexico (non-NAFTA), Morocco, Nicaragua, and Singapore are not subject to HTS Chapter 99, Subchapter IV, U.S. Note 1 and that imports from these counties should be presented as a type 02 entry using the high rate (over quota) HTS Chapter 52 number without the HTS Chapter 99 number and must be reported through the quota module of ACS.

In addition, CBP states that certain NAFTA imports from Mexico are covered under Chapter 99, Subchapter 6, HTS provisions 9906.52.03, 9906.52.04, 9906.52.06, or 9906.52.07.

2. Miscellaneous CBP Messages on AD and CV Duty Actions

CBP has issued administrative messages on a number of antidumping (AD) and countervailing (CV) duty actions, many of which (marked by an * in the action column) were previously published in the Federal Register by the International Trade Administration (ITA) and summarized in International Trade Today.

(The administrative messages marked with an * cover much of the same information as the ITA notices; however, CBP's messages often list the 10-character case number specific to each listed company(s). ITA notices only list the 7-character master case number. In addition, sometimes the master case number for CBP purposes (in parentheses, below, where applicable) differs from the ITA master case number.)

Important! CBP will discontinue issuing administrative messages on AD and CV duty actions effective on approximately September 30, 2006. CBP's AD/CV searchable database on its Web site, http://addcvd.cbp.gov/ , will then be the sole CBP forum for these notices.
