CBP Issues Final Rule on ATPDEA Trade Benefits (Part I)

U.S. Customs and Border Protection (CBP) has issued a final rule, effective September 6, 2006, which adopts as final, with some changes, interim amendments to 19 CFR Parts 10, 163, and 178, which were published on March 25, 2003 as T.D. 03-16, to implement the trade benefit provisions for designated Andean countries contained in the Andean Trade Promotion and Drug Eradication Act (ATPDEA).

The ATPDEA trade benefits include:

the entry of specific apparel and other textile articles free of duty and free of any quantitative restrictions;

the extension of duty-free treatment to specified non-textile articles (e.g., certain footwear, petroleum, watches, handbags, etc.) normally excluded from duty-free treatment under the Andean Trade Preference Act (ATPA), if the President finds those articles to be not import-sensitive in the context of the ATPDEA; and

the entry of certain tuna free of duty and free of any quantitative restrictions.

CBP states that the regulatory amendments adopted as a final rule reflect and clarify the statutory standards for the trade benefits under the ATPDEA and also include specific documentary, procedural and other related requirements that must be met in order to obtain those benefits.
