New Chapter 99 Number Required for Trousers/Shorts Made of U.S. Fabric/Yarn
According to CBP, HTS 9915.61.05 must be used to enter originating cotton and man-made fiber (MMF) trousers, breeches, or shorts from Nicaragua that are made from U.S. formed fabric of U.S. formed yarn, and classified under any of the following Chapter 62 subheadings:
6203.42.40 | 6203.43.35 |
6203.49.80 | 6204.62.40 |
6204.69.25 | 6204.69.60 |
6210.40.90 | 6210.50.50 |
6211.20.38 | 6211.20.68 |
6211.42.00 | 6211.43.00 |
In addition, such originating goods entered under HTS 9915.61.05 must also use the special program indicator (SPI) "P" and the HTS Chapter 62 provision.
(In a recently revised document on textile and apparel tariff shift rules, under the title "Earned TPL," CBP had stated that HTS 9915.61.05 will be used to measure imports from Nicaragua of cotton/MMF trousers using U.S. fabric from U.S. yarn (as a subset of originating goods made from yarn and fabric from any DR-CAFTA country). If Nicaragua doesn't live up to its commitment to ship a certain volume of MMF and cotton trousers made of U.S. fabric of U.S. yarn (formerly under CBTPA), CBP had stated that Nicaragua's TPL may be reduced by a commensurate amount in the subsequent year.)
