CV: Italy Certain Pasta

The International Trade Administration (ITA) has issued the final results of its countervailing (CV) duty administrative review of certain pasta from Italy for the period of January 1, 2004 through December 31, 2004.

Revocation of CV Duty Order for Pasta Lensi (as Producer/Exporter)

Based on its examination of the data submitted by Pasta Lensi S.r.l. (Pasta Lensi), CBP is revoking the CV duty order with respect to certain pasta from Italy produced and exported by Pasta Lensi. Suspension of liquidation will be terminated for such entries with a time of entry on or after January 1, 2005 and the ITA will instruct U.S. Customs and Border Protection (CBP) to refund any cash deposits for such entries.

(a) The ITA has determined that a final CV duty rate of zero exists; suspension of liquidation will continue (except as noted above for Pasta Lensi as producer and exporter), but no CV cash deposit will be required;

(b) The ITA has determined that a final de minimis CV duty rate of 0.12% (Corticella/Combattenti) and 0.20% (Atar) exists; suspension of liquidation will continue, but no CV cash deposit will be required;

(c) For all other companies that were not reviewed (except Barilla G.e R.F.lli S.p.A and Gruppo Agricoltura Sana S.r.L, which are excluded from the CV duty order), the ITA will instruct CBP to collect CV duty cash deposits of estimated CV duties at the most recent company-specific or all-others rate applicable to the company. These rates shall apply to all non-reviewed companies until a review of a company assigned these rates is requested.

Assessment Instructions for the Review Period (01/01/04 - 12/31/04)

Because the CV duty rates for all of the above-noted companies are zero or de minimis, the ITA will instruct CBP to liquidate entries during the period of January 1, 2004 through December 31, 2004, without regard to CV duties. The ITA states that it will issue appropriate assessment instructions directly to CBP within 15 days of June 26, 2006.

For all other companies that were not reviewed (except Barilla G.e R.F.lli S.p.A. and Gruppo Agricoltura Sana S.r.L, which are excluded from the CV duty order), the ITA has directed CBP to assess CV duties on all entries between January 1, 2004 and December 31, 2004 at the rates in effect at the time of entry.
