CBP Posts Four Informed Compliance Publications That Were Reviewed Without Change

U.S. Customs and Border Protection (CBP) has posted four recently reviewed Informed Compliance Publications (ICPs), with March 2006 updates, to its Web site.

Timely, relevant coverage of court proceedings and agency rulings involving tariffs, classification, valuation, origin and antidumping and countervailing duties. ICPs Reviewed With No Changes

The following ICP's were reviewed with no changes:

The Agricultural Actual Use Provisions. CBP provides a study in the classification of two special provisions associated with agriculture, HTS 9817.00.50 and 9817.00.60. CBP states that this ICP provides guidance regarding the classification of imported merchandise, including the three-part test for determining if a good can be imported under either of the above-listed HTS subheadings, actual use certification, etc.

Household Articles of Base Metal. In this ICP, CBP examines what constitutes table, kitchen, cooking, other household, sanitary ware, and non-electric heating appliances. The ICP covers Chapters 73, 74, 76, 79, and 80 (household articles of iron or steel, copper, aluminum, zinc, and tin, respectively). In addition, there is information on classification of alloys and composite articles, etc.

Internal Combustion Piston Engines. CBP examines the classification of internal combustion piston engines and provides, among other things, a technical overview of subject merchandise, discussion of engines of headings 8407, 8408 and parts of engines classified in 8409. The ICP also provides examples of engine part classifications, etc.

Machine Tools. CBP states that this ICP is a study in the classification of machine tools, parts and accessories under HTS 8456 - 8466. In addition to discussion of these headings, the ICP also provides information on unfinished machines vs. parts. The ICP also discusses machines and apparatus that are often misclassified as machine tools of HTS 8456 - 8465.

According to CBP, these publications are intended to provide guidance and information to the trade community, and they reflect the position on or interpretation of, the applicable laws or regulations by CBP as of March 2006. Importers may wish to obtain a ruling from CBP or to obtain advice from an expert who specializes in customs matters.
