AD: Russia Silicon Metal

On February 16, 2006, the International Trade Administration (ITA) issued a notice amending its final affirmative antidumping (AD) duty determination for silicon metal from Russia, as there is now a final and conclusive court decision in this case.

As a result, the ITA will direct U.S. Customs and Border Protection (CBP) to require the AD cash deposit rates listed below for the subject merchandise, effective as of December 14, 2005, the publication date of the Timken notice:

With regard to the ITA's amended final affirmative determination on subject merchandise, the Court of International Trade (CIT) remanded to the ITA, among other things, its treatment of silicon metal fines. After the ITA issued its first remand results, the CIT affirmed the ITA's determination to include recycled silicon metal fines sized zero to five millimeters in each producer's factors of production cost analysis and affirmed the calculation of Bratsk's AD duty margin. However, the CIT further remanded the case back to the ITA and ordered it to either recalculate or explain Kremny's AD duty margin according to certain instructions.

In its second remand results, The ITA recalculated Kremny's AD duty margin using the AD duty margin for Bratsk calculated in the first remand results. In November 2005, the CIT affirmed the ITA's second remand results in its entirety.
