CBP Soon Ready to Implement "Phase 4" Enforcement for Mandatory Advance Electronic Information Requirements for Truck Carriers

U.S. Customs and Border Protection (CBP) may soon implement "Phase 4", CBP's next step in enforcing mandatory advance electronic information requirements for truck carriers, as required by the Trade Act of 2002.

Three enforcement phases have already been implemented to date: Phase 1 (In-bond - QP/WP and CAFES), Phase 2 (Pre-Arrival Processing System (PAPS)) and Phase 3 (Border Release Advance Screening and Selectivity (BRASS).)

"Phase 4" Expected to Reflect Availability of New ACE e-Manifest: Trucks

According to sources, Phase 4 is expected to reflect the fact that the new Automated Commercial Environment (ACE) e-Manifest: Trucks is an option for providing the advance electronic information required by the Trade Act of 2002, as an alternative to the in-bond - QP/WP and CAFES, PAPS, or BRASS methods currently allowed by CBP.

(A CBP fact sheet states that ACE e-Manifest: Trucks allows the electronic filing of manifests to CBP prior to a truck's arrival at certain U.S. land border crossings, in compliance with the Trade Act of 2002. According to the fact sheet, e-Manifests: Trucks may be submitted using the ACE Secure Data Portal, or a CBP-approved Electronic Data Interchange (EDI): either the carrier's in-house self-developed software that interfaces with CBP; an application provided by a software vender to the carrier; or by a third party service provider employed by the carrier to enter manifest data manually on the carrier's behalf.
