CBP Issues Notices on 2006 TPLs for Textiles and Apparel from Canada , Mexico

U.S. Customs and Border Protection (CBP) has posted separate notices to its Web site which list the calendar year 2006 Tariff Preference Levels (TPLs) for certain textiles and apparel from Canada or Mexico. These 2006 TPLs are set at the same levels as the 2005 TPL levels.

According to CBP, opening day for these 2006 TPLs was Tuesday, January 3, 2006 at 12 noon EST, or its equivalent in other time zones.

Canadian TPLs. The eight Canada TPLs, which are implemented under HTS Section XI, Additional U.S. Notes (AUSNs) 3, 4, and 5, and operate as tariff-rate quotas (TRQs), are for Canadian textiles and apparel which do not qualify as "originating goods" under the North American Free Trade Agreement (NAFTA) preference rules of origin.

"Non-originating" textiles and apparel from Canada which meet the criteria for the TPLs receive the lower Canada/NAFTA preferential rate of duty on imports into the U.S. until the TPL fills. As of December 23, 2005, none of the Canada TPLs had filled and none were estimated to close early.

Mexican TPLs. The six Mexican TPLs, which are implemented under HTS Section XI AUSNs 3, 4, and 5, and operate as TRQs, are for Mexican textiles and apparel which do not qualify as "originating goods" under the NAFTA preference rules of origin.

"Non-originating" textiles and apparel from Mexico which meet the criteria for the TPLs receive the lower Mexico/NAFTA preferential rate of duty on imports in to the U.S. until the TPL fills. The 2005 Mexico TPLs that filled as of December 23, 2004 were TPLs 1 and 2.

(Each notice also lists the AUSN subpart for most of the listed TPLs, the reporting unit (e.g. kg., no., SME) for various TPLs and/or HTS numbers, the HTS Chapter 99 tariff numbers, etc.)
