Amended Final Results of AD Duty Administrative Review

The ITA states that this amendment is being made in order to correct certain ministerial errors in the AD final administrative review results calculations for Eurodif/COGEMA.

As a result, for shipments with a time of entry on or after October 21, 2005, the ITA has issued the following amended AD cash deposit instructions for Eurodif/COGEMA:

AD Cash Deposit Instructions for a Time of Entry On/After 10/21/05:

CompanyAD Duty Rate or Note
Eurodif S.A., Compagnie Gnrale Des Matires Nuclaires, S.A. and COGEMA, Inc. (collectively Eurodif/COGEMA)9.75% (from 12.62%)

Assessment Instructions for the Review Period (02/1/03 - 1/31/04):

The ITA states that it has calculated importer-specific duty assessment rates, and where the assessment rate is above de minimis (i.e., at or above 0.50 percent), the ITA states it will instruct CBP to assess duties on all entries of subject merchandise by that importer.

However, the ITA states it will not issue liquidation instructions for any entries of Eurodif/COGEMA merchandise until such time as the July 1, 2002 injunction issued by the Court of International Trade (CIT) is lifted.

(See ITA notice for further information, including scope of AD order. See ITT's Online Archives or 09/2205 news, (Ref:05092235), for BP summary of the final results of this AD duty administrative review.)
