CV: France, Germany, Netherlands, United Kingdom Low Enriched Uranium
The International Trade Administration (ITA) has issued the final results of its countervailing (CV) duty administrative reviews of low enriched uranium from France, Germany, the Netherlands, and the United Kingdom for the period of January 1, 2003 through December 31, 2003.

Pursuant to section 701(d) of the Tariff Act of 1930, the ITA has previously ruled that Urenco Group operates as an international consortium comprised of Urenco Ltd., Urenco Inc., Urenco Deutschland GmbH of Germany, Urenco Nederland B.V. of the Netherlands, and Urenco (Capenhurst) Ltd. of the United Kingdom.
(a) The ITA states that for companies that were not reviewed, the ITA will instruct CBP to collect estimated CV duty cash deposits at the most recent company-specific rate, or if there is no company-specific rate at the all others rate of 12.15%.
(b) The ITA states that the total CV duty rate for the Urenco Group is zero, no CV cash deposit will be required; however liquidation will remain suspended.
(c) The ITA states that for companies that were not reviewed, the ITA will instruct CBP to collect estimated CV duty cash deposits at the most recent company-specific rate, or if there is no company-specific rate at the all others rate of 2.23%.
Assessment Instructions for the Review Period (01/01/03 -12/31/03)
France. The ITA explains that it has been enjoined from liquidating entries of the subject merchandise from France. Therefore, it does not intend to issue liquidation instructions to U.S. Customs and Border Protection (CBP) for entries made during the period January 1, 2003 through December 31, 2003, until such time as the injunctions, issued on June 24, 2002, and November 1, 2004, are lifted.
Germany, Netherlands, & United Kingdom. The ITA will instruct CBP within 15 days of July 12, 2005 to liquidate shipments of low enriched uranium by the Urenco Group from Germany, the Netherlands, and the United Kingdom with a time of entry from January 1, 2003 through December 31, 2003, without regard to CV duties.
In addition, the ITA states that for the period of January 1, 2003 through December 31, 2003, the assessment rates applicable to all non-reviewed companies covered by these CV duty orders are the cash deposit rates in effect at the time of entry.
