CBP Administrative Messages, Web Postings, Etc

U.S. Customs and Border Protection (CBP) at Los Angeles/Long Beach has issued an administrative message (dated 05/25/05) which CBP sources state indicates that until a recent Court of International Trade (CIT) decision on chondroitin sulfate (CS) is final, or is appealed and is final, filers and importers must continue to classify CS under 3913.90.2000.

1. LA/Long Beach Admin Message on Classification of Chondroitin Sulfate

The message adds that filers or importers should not file a PEA/SIL until further notice, but that protests will continue to be accepted, and will be placed into suspended disposition pending instructions from CBP Headquarters.

(The message states that CIT Slip. Op. 05-48 overturned CBP's policy of classifying CS under 3913.90.2000. The CIT decision agreed with the plaintiff that CS should be classified under 3001.90.0000 (duty-free). See ITT's Online Archives or 05/19/05 news, 05051925 for BP summary of CIT decision.)

CBP has posted the following to its Web site:

o China safeguard quotas on 301, 340/640, 638/639, and 647/648. These new China safeguard quotas are in effect for exports during the period of May 27, 2005 - December 31, 2005. 3. Miscellaneous CBP Messages on AD and CV Duty Actions

CBP has issued messages on a number of antidumping (AD) and countervailing (CV) duty actions, many of which (marked by an * in the action column) were previously published in the Federal Register by the International Trade Administration (ITA) and summarized in International Trade Today.

(The CBP messages marked with an * cover much of the same information as the ITA notices; however, CBP's messages often list the 10-character case number specific to each listed company(s). ITA notices only list the 7-character master case number. In addition, sometimes the master case number for CBP purposes (in parentheses, below, where applicable) differs from the ITA master case number.)
