April 13, 2005 CBP Bulletin on Silymarin (Milk Thistle) and Leucoanthocyanin

In the April 13, 2005 issue of the U.S. Customs and Border Protection Bulletin (CBP Bulletin) (Vol. 39, No. 16), CBP issued a notice withdrawing a proposed modification of a classification ruling on silymarin (milk thistle) and leucoanthocyanin.

Withdrawal of a Proposed Modification of a Classification Ruling

Silymarin (Milk Thistle) and Leucoanthocyanin. At issue were (i) silymarin, which is a yellow powder that contains 80% mixture of isomers of silymarin (silybin, silicristin and silidianin), and (ii) leucoanthocyanin, which is a brownish powder consisting of 90-95% oligomeric proanthocyanidin (OPC).

CBP had proposed to issue HQ 967099 in order to modify NY 814027 and reclassify the silymarin and leucoanthocyanin in HTS 3824.90.2800 as "chemical products and preparations of the chemical or allied industries, etc.: other mixtures containing 5% or more by weight of one or more aromatic or modified aromatic substances" rather than in HTS 1302.19.4040 as "vegetable saps and extracts: other substances having anesthetic, prophylactic or therapeutic properties."

However, CBP states that it is withdrawing its proposed modification due to its belief that there is merit to the alternative classification of silymarin proposed in a received comment.

According to CBP, pending further review of the classification of this merchandise, a new proposal may be published.
