U.S. Customs and Border Protection (CBP) has posted to its Web site a notice announcing the tariff-rate quota (TRQ) for peanuts that are provided for in HTS Chapter 12, Additional U.S. Note (AUSN) 2 and entered under HTS 1202.10.4020, 1202.10.4040, 1202.20.4020, 1202.20.4040, 2008.11.2500, and 2008.11.4500 during the April 1, 2005 through March 31, 2006 period.

1. 2005-2006 TRQ for Peanuts Opens April 1, 2005
According to CBP, this TRQ will open on Friday, April 1, 2005 at 12 noon, E.S.T., or its equivalent in other time zones with the following countries/areas having the following low-duty quantities:

CBP states that this TRQ is expected to oversubscribe at opening, and filers are advised against using the Automated Clearing House (ACH) as a form of payment. CBP further states that in accordance with U.S. Department of Agriculture (USDA) regulations, imported raw peanuts under HTS 1202.10.40, 1202.10.80, 1202.20.40, and 1202.20.80 from the following countries are prohibited from entry: Burkina Faso, China, India, Indonesia, Ivory Coast, Japan, Philippines, Senegal, Thailand, and Taiwan. 2. March 24th Opening of 180-Day Special Import Quota for Upland Cotton (Announcement Number 17)
CBP has posted to its Web site a notice announcing a "weekly" special import quota of 26,158,106 kg for upland cotton purchased not later than June 21, 2005 and entered under HTS 9903.52.17. The quota period is March 24, 2005 through September 19, 2005; the opening date is March 24, 2005 at 12 noon, E.S.T., or its equivalent in other time zones.
According to CBP, the use of the "special import quota" is at the importer's option and is not subject to the tariff-rate quotas (TRQs) in HTS Chapter 52 Additional U.S. Notes (AUSNs) 5 through 10. CBP has previously stated that these 180-day quotas are established pursuant to a 1991 Presidential Proclamation, are "triggered" by high C.I.F. Northern European cotton prices, and are provided for in HTS Chapter 99, Subchapter III, U.S. Note 6.
