CBP Issues Interim Rule on the U.S.-Chile FTA

U.S. Customs and Border Protection (CBP) has issued an interim rule, effective March 7, 2005, which amends 19 CFR Parts 10, 24, 162, 163, 178, and 191 for the U.S.-Chile Free Trade Agreement (US-CFTA).

CBP states that comments on this interim rule must be received by June 6, 2005.

Interim Rule Adds New Subpart H to 19 CFR Part 10

CBP's interim rule adds a new Subpart H entitled 'U.S.-Chile Free Trade Agreement' to 19 CFR Part 10, as follows:

General Provisions (19 CFR 10.401 - 19 CFR 10.402)

Import Requirements (19 CFR 10.410 - 19 CFR 10.416)

Tariff Preference Level (19 CFR 10.420 - 19 CFR 10.425)

Export Requirements (19 CFR 10.430 - 19 CFR 10.431)

Post-Importation Duty Refund Claims (19 CFR 10.440 - 10.442)

Rules of Origin (19 CFR 10.450 - 19 CFR 10.463)

Origin Verifications and Determinations (19 CFR 10.470 - 19 CFR 10.474)

Penalties (19 CFR 10.480 - 19 CFR 10.483)

Goods Returned After Repair or Alteration (19 CFR 10.490)

The interim rule also makes conforming changes to 19 CFR Parts 10, 24, 162, 163, 178, and 191. In addition, in order to create a new Subpart H in 19 CFR Part 10, this interim rule re-designates the previous sections in 19 CFR Part 10 into Subparts A-G.

BP has previously referred to the US-CFTA as the UCFTA or CFTA.
