U.S. Customs and Border Protection (CBP) has presented its final version of is new Customs-Trade Partnership Against Terrorism (C-TPAT) security standards for importers to the Departmental Advisory Committee on Commercial Operations of Customs and Border Protection and Related Functions (COAC). During the February 15, 2005 COAC meeting, CBP officials noted that they will also be issuing frequently asked questions (FAQs) and responses regarding the revised C-TPAT security standards. 2. Importer's CIT Case Against Threat-Based China Safeguards May Take Six Months or Longer to be Concluded
According to a recent article in American Shipper, U.S. apparel importers are getting what they wanted - barring a successful appeal of the CIT's injunction (which is preventing CITA from taking further action on threat-based China safeguard petitions) - a period of time, perhaps six months or longer, until their case in the CIT is concluded, to see if China-spawned market disruptions actually occur in the U.S. (American Shipper, dated February 2005, www.americanshipper.com.)
3. Joint Replies to Shippers' Associations' FMC/NSA Petitions Available
The National Industrial Transportation League (NITL) has made available on its Web site the two joint replies that it filed together with the United Parcel Service (UPS), BAX Global, FedEx Trade Networks Transport & Brokerage, the Transportation Intermediaries Association, C.H. Robinson Worldwide, and BDP International in opposition to the petitions of the International Shippers' Association (ISA) and the American Institute for Shippers' Associations (AISA) for reconsideration of the FMC's NVOCC Service Arrangement (NSA) final rule. 4. DEA Temporary Waiver of Certain Import/Export Reporting Requirements for Certain Chemical Mixtures
The Drug Enforcement Administration (DEA) has issued a temporary waiver of certain import/export reporting requirements set forth in a December 15, 2004 final rule. DEA states that regulated persons will not be required until May 14, 2005 to submit advance notification for import, export, and transshipment transactions for chemical mixtures regulated solely due to the presence of any of 27 chemicals listed in the Controlled Substances Act. 5. Treasury Final Rule Makes Changes to Terrorism Risk Insurance Program
The Treasury Department has issued a final rule, effective February 14, 2005, in order to make minor technical changes to the "make available" provision and the "insurer deductible" definition at 31 CFR Part 50 (Terrorism Risk Insurance Program). 6. Coast Guard's National Maritime Security Advisory Committee to Meet, Etc.
The Coast Guard has issued a notice announcing that the National Maritime Security Advisory Committee (NMSAC) will hold a public, inaugural meeting on March 3, 2005 in Alexandria, VA to discuss various issues relating to national maritime security. In addition, the Coast Guard's notice announces the members that have been appointed to the NMSAC. 7. CPSC to Hold Public Meeting on Petition Requesting Ban on Sale of Adult ATVs Sold for Use of Children under 16 Years
The Consumer Product Safety Commission (CPSC) has announced that it will hold a public meeting on March 22, 2005 in Bethesda, MD in order to receive oral comments concerning Petition CP 02-4/HP-02-1, which requested that the CPSC issue a rule banning the sale of adult-size four wheel all terrain vehicles (ATVs) sold for the use of children under 16 years old. 8. President's Export Council Subcommittee to Hold Partially Open Meeting
The Bureau of Industry and Security (BIS) has announced that the President's Export Council Subcommittee on Export Administration will hold a partially open meeting on March 8, 2005 in Washington, DC in order to, among other things, receive a BIS and Export Administration update. 9. State Department's Shipping Coordinating Committee to Meet
The State Department has announced that the Shipping Coordinating Committee will hold an open meeting on March 16, 2005 in Washington, DC in order to begin preparations for the 48th Session of the International Maritime Organization (IMO) Sub-Committee on Stability and Load Lines and on Fishing Vessels Safety to be held at IMO Headquarters in London from September 12-16, 2005.
