CBP Issues Notice on 2005 TPLs for Textiles and Apparel from Canada, Mexico

U.S. Customs and Border Protection (CBP) has posted separate notices to its Web site which list the calendar year 2005 Tariff Preference Levels (TPLs) for certain textiles and apparel from Canada and Mexico. These 2005 TPLs are set at the same levels as the 2004 TPL levels (with the exception of one Mexico TPL which expired, see below).

According to CBP, opening day for these 2005 TPLs was Monday, January 3, 2005 at 12 noon EST, or its equivalent in other time zones.

Canadian TPLs. The eight Canada TPLs, which are implemented under HTS Section XI, Additional U.S. Notes (AUSNs) 3, 4, and 5, and operate as tariff-rate quotas (TRQs), are for Canadian textiles and apparel which do not qualify as "originating goods" under the North American Free Trade Agreement (NAFTA) preference rules of origin. "Non-originating" textiles and apparel from Canada which meet the criteria for the TPLs receive the lower Canada/NAFTA preferential rate of duty on imports into the U.S. until the TPL fills. As of December 30, 2004, none of the Canada TPLs had filled; however, TPL 3 was on hold at 99.48% filled and its sublevel TPL 4 was on hold at 49.47% filled.

Mexican TPLs. The six Mexican TPLs, which are implemented under HTS Section XI AUSNs 3, 4, and 5, and operate as TRQs, are for Mexican textiles and apparel which do not qualify as "originating goods" under the NAFTA preference rules of origin. "Non-originating" textiles and apparel from Mexico which meet the criteria for the TPLs receive the lower Mexico/NAFTA preferential rate of duty on imports in to the U.S. until the TPL fills. The 2004 Mexico TPLs that filled as of December 30, 2004 were TPLs 1, 2, and 3. However, TPL 3 expired on December 31, 2004.

Upcoming certificate of eligibility changes. Each notice states that programming updates will take place early in 2005 to require Automated Broker Interface (ABI) filers to transmit the Certificates of Eligibility in the certificate field of the line information, as opposed to the current practice of transmitting the Certificate of Eligibility number in the visa field of the line information. (Each notice also lists the HTS U.S. Note for most of the listed TPLs, the reporting unit (e.g. kg., no., SME) for various categories and/or HTS numbers, the HTS numbers for the first and second tariff field, etc.)
