Wool License Requirement Extended to New HTS 9902.51.15 and 9902.51.16

U.S. Customs and Border Protection (CBP) has issued an administrative message stating that the Miscellaneous Trade and Technical Corrections Act of 2004 (Public Law (P.L.) 108-429) created a wool license requirement for new tariff numbers HTS 9902.51.15 and 9902.51.16.

CBP has also issued a second administrative message stating that ACS programming has been completed so that it can accept the wool license information for these two new tariff numbers.

(P.L. 108-429 created new duty-free tariff-rate quotas (TRQs) for:

HTS 9902.51.15 - fabrics of combed wool, containing 85% or more by weight of wool, with wool yarns of average fiber diameters of 18.5 micron or less, under the terms of U.S. note 16(b) to this subchapter (provided for in subheading 5112.11.30 or 5112.19.60); and

HTS 9902.51.16 - fabrics of combed wool containing 85% or more by weight of wool, with wool yarns of average fiber diameters of 18.5 micron or less, under the terms of [new] U.S. Note 17 to this subchapter (provided for in subheading 5112.11.30 or 5112.19.60).

Although CBP's message refers to HTS 9902.51.15 and 9902.51.16, the 2005 HTS indicates that both HTS 9902.51.15 and 9902.51.16 each have two statistical breakouts.

CBP sources have stated by phone that they expect the wool license requirement to apply only to two of the four statistical breakouts - 9902.51.1550 and 9902.51.1650 - and not to HTS 9902.51.1510 and 9902.51.1610, which cover fine animal hair of Kashmir (cashmere) goats. CBP sources note that they expect an upcoming Presidential Proclamation on P.L. 108-429 to provide guidance on this issue.

Requirements for Transmitting a " Wool License"

According to CBP, the requirements for transmitting a "wool license" for HTS 9902.51.11 and 9902.51.12 will also apply to new HTS 9902.51.15 and 9902.51.16.

(CBP states that these requirements are outlined in administrative message 00-1349, which states that this wool license will be issued by the Department of Commerce; its 9 character number shall be included on the entry summary, CF 7501 or an electronic equivalent; the license number field will appear in column 34 of the 7501; etc.)
