New Set of Amendments to the Harmonized System of Explanatory Notes (Part IX)

The World Customs Organization (WCO) has issued an amending supplement (No. 5, dated February 2004) to the Harmonized System (HS) Explanatory Notes (ENs). (Although not binding by U.S. Customs and Border Protection (CBP), the ENs are followed by CBP whenever possible.)

The following are short summaries of the amendments made to the ENs by this latest amending supplement:

1. Machinery for Making Pulp of Fibrous Cellulosic Material or for Making or Finishing Paper or Paperboard Under HS 84.39

Machinery for making paper or paperboard. Machines for forming the stock into continuous sheets of paper or paperboard, etc. On page 1496, under Item "(II) Machinery for Making Paper or Paperboard," paragraph (A) has been revised to read as follows: Machines for forming the stock into continuous sheets of paper or paperboard (e.g., Fourdrinier machines or twin wire machines). These are very complex machines. They consist of regulators for feeding the stock to the head box, a slice at the output end of the head box for distributing the stock onto an endless band, usually a woven fabric of synthetic monofilaments, supported on a breast roll or a forming roll, foils, table rolls, shake mechanism, suction boxes, dandy rolls for watermarking, couch rolls for increasing the dry solids content and consolidating the paper, press rolls forming at least one press nip, one press roll may include a press shoe and a surrounding, rotable belt loop, in which the paper is pressed against one or between two endless felt belts or other process belts, drying rolls, steam boxes, etc., and usually also calendar rolls and reeling devices, etc.

(This paragraph had previously read: "Machines for forming the pulp into continuous sheets of paper or paperboard (e.g., Fourdrinier machines). These are very complex machines. They consist of regulators for feeding the pulp to the breast box, a slice at the output end of the breast box for distributing the pulp on to the wire, an endless band of fine wire cloth (usually an alloy of copper, tin, etc.) or woven fabric of synthetic monofilaments, supported on tube rolls, shake mechanism, suction boxes, dandy rolls for watermarking, couch rolls for partly drying and consolidating the paper, press rolls between which the paper is pressed against an endless band of felt, drying rolls, etc., and usually also calendar rolls and cutting and reeling devices, etc.")

Vat machines. Paragraph (B) on page 1496 has been revised so that it is now entitled "Vat machines" rather than "Board machines (normally used for the manufacture of paperboard) and mould machines." In addition, in the second sentence of the paragraph is revised to read: "The paper or paperboard is produced either in the form of continuous web or in sheets" rather than "The paper or paperboard is produced either in the form of continious strip or in sheets." Finally, the last sentence of the paragraph, which read "Machines of this type are also used for the manufacture of asbestos or asbestos-cement boards," has been deleted.

Machines for the manufacture of multi-layered paper, board or paperboard. On Page 1496, paragraph "(C) Machines for the manufacture of multi-layered paper, board or paperboard" has been revised to read as follows: These machines consist of different combinations of Fourdrinier formers or twin wire formers. The different web layers are produced simultaneously and are joined in a humid state in the machines as a rule with out a binder."

(This paragraph had previously read: "Machines for the manufacture of multilayered paper or paperboard. These machines consist of several superimposed devices for forming pulp into sheets or of a battery of board machines, or of machines combining these two types. The different layers of pulp produced simultaneously are joined in the machine in a humid state without a binder.")

Small drawing apparatus for making paper samples intended for testing. On page 1497, the title of paragraph (D) has been revised to read: "Small drawing apparatus for making paper samples intended for testing" rather than "small machinery for making paper samples intended for testing."

Machinery for finishing paper or paperboard. On page 1497, under item "(III) Machinery for finishing paper or paperboard," paragraph (B) has been revised by adding the phrase "inorganic or organic pigment layers" between the words "coatings" and "size." Paragraph (B) has also been revised by adding the word "silicon" between the words "gum" and "wax." Finally, in paragraph (B), the phrase "varnish, enamel, metal powder" has been removed between the words "gum" and "wax."

In addition, paragraph "(D) flint glazing or hammer glazing machines" has been removed and paragraphs (E) through (IJ) have been reordered as paragraphs (D) through (H).

Parts. On page 1498, under the heading "Parts" the list of parts of machinery that are classified under HS 84.39 has been revised to read: "Backfalls; bedplates and beater bars for beaters; couch rolls; suction boxes; cylinders for vat machines; dandy rolls."

(This sentence previously read: "Toothed cylinders for esparto grass openers; backfalls; bedplates and beater bars for beaters; couch rolls; suction boxes; wire mesh cylinders for mould machines; dandy rolls.")

With regard to the list of those parts that are not regarded as being of HS 84.39, item (a) has been revised to provide for: "endless belts of textile materials, for Fourdrinier machines and twin wire machines, and felt roller covers (heading 59.11)"

(Item (a) previously provided for: "felt roller covers (and also endless belts of textile material, whether or not felted) of heading 59.11 or 68.12).")

In addition, item (c) which provided for "unmounted agates for glazing machines (heading 71.03)." has been deleted. As a result of this change, items (d) through (f) have now been reordered as items (c) through (e).
