CV: Italy Certain Pasta

The International Trade Administration (ITA) has issued the final results of its administrative review of the countervailing (CV) duty order on certain pasta from Italy for the review period of January 1, 2002 through December 31, 2002.

Final Results of CV Duty Administrative Review

For entries on or after December 7, 2004, suspension of liquidation will continue for the affected companies at the CV cash deposit rates described below:

The ITA notes that during the first part of the period of review (calendar year 2002), Pasta Zara 2 was named Societa per Azioni Pasta Giulia S.p.A.; on September 9, 2002, the company changed its name to Pasta Zara 2.

The ITA states that Lensi is the successor-in-interest to IAPC Italia S.r.l.

The ITA has previously stated that Corticella and Combattenti are both producers of subject merchandise and are owned by the same holding company, Euricom S.p.A.

(a) A final de minimis CV duty rate has been calculated for these companies at the following rates: Pagani, 0.06%; Corticella and Combattenti, 0.09%; Zara, 0.30%; Russo/Di Nola, 0.16%, suspension of liquidation will continue, but no cash deposits will be required.

(b) A final CV duty rate of zero has been calculated for Lensi, suspension of liquidation will continue, but no cash deposit will be required.

(c) For all non-reviewed companies, the ITA states that it will instruct CBP to collect cash deposits of the estimated CV duties. The ITA states that the rate will be the most recent company-specific or all others rate applicable to the company (except for Barilla G.e.R.F.lli S.p.A. (Barilla) and Gruppo Agricoltura Sana S.r.L. (Agricoltura), which are excluded from this CV duty order).

Assessment Instructions for the Review Period (01/01/02 - 12/31/02)

Because the CV duty rates for all of the above-noted companies are zero or de minimis, the ITA will instruct CBP to liquidate entries during the period of January 1, 2002 through December 31, 2002 without regard to CV duties. The ITA states that it will issue appropriate assessment instructions directly to CBP within 15 days of December 7, 2004.

For all other companies that were not reviewed (except Barilla G.e.R. F.lli S.p.A. and Gruppo Agricoltura Sana S.r.L., which are excluded from the order), the ITA has directed CBP to assess CV duties on all entries between January 1, 2002 and December 31, 2002 at the rates in effect at the time of entry.
