CBP's Expanded and Revised FAQ on Mandatory Advance Electronic Information Requirements for Truck Cargo
U.S. Customs and Border Protection (CBP) has issued a November 10, 2004 version of its September 13, 2004 Frequently Asked Questions (FAQ) and responses regarding the mandatory advance electronic cargo information requirements for trucks.

The November 10, 2004 truck FAQ completely replaces the initial FAQ posted on September 13, 2004. The new version modifies certain of the initial FAQs 1-18, as well as adds FAQs 19-21.

FAQ 19 - Procedures for PAPS Users During ACS Down Times
In response to new FAQ 19 asking what procedures will be used during ACS down times for PAPS users, CBP states that in the event that an entry is presented for release using PAPS when either the CBP system is down, or the Automated Broker Interface (ABI) is down, the driver will be sent to the entry filer to obtain the following: (1) ABI System Down Letter, and (2) a CBP Form 3461Alt.
Both of these documents must be attached to the release copy of the invoice in order for the cargo to move under the currently established down time procedures. According to CBP, this is necessary in part because with only a PAPS label on the paperwork, and nothing in the electronic systems, there is nothing to obligate the filing of an entry. Additionally, in the event that follow up is needed, CBP cannot call the filer with only a Standard Carrier Alpha Code/Pro-Bill number (SCAC/Pro) combination to find out the status. CBP notes that an entry number is required for tracking purposes.
CBP states that if the release is at a "Permit" Port, the filer will be required to fax a signed letter which includes the entry number, or a copy of the CBP Form 3461 which obligates the firm to file the subsequent entry documentation.
FAQ 21 - Use of More than One Filer Code on CBP Form 7533 for PAPS Users
In new FAQ 21, CBP states that more than one filer code can be provided on the same CBP Form 7533 when using PAPS. According to CBP, the automation rule applies to the carrier; therefore, there is no restriction on filer codes. However, the manifest must clearly designate filers on each PAPS label.
