CBP to Modify ABI to Accept Diamond Certificate Numbers Effective December 1, 2004

U.S. Customs and Border Protection (CBP) has issued an ABI administrative message stating that it will make future changes to the Automated Commercial System (ACS) to automate the reporting of diamond certificate numbers (aka 'Kimberly Process certificate' numbers) for certain diamond tariff numbers.

Certificate Number Required for ABI Summaries with a Dec. 1, 2004 Duty Computation Date

CBP states that the diamond certificate number requirement is scheduled to be effective for ABI summaries that have a duty computation date of December 1, 2004.

Certificate Number Required for Non-ABI Summaries Beginning Nov. 1, 2004

CBP and OFAC sources have confirmed that the diamond certificate number will be required for non-ABI summaries for such diamond entries beginning November 1, 2004.

Subscribers should note that OFAC's final rule reflects November 1, 2004 as the effective date for transmitting the certificate number either ABI or non-ABI; however, CBP and OFAC sources have confirmed that, as programming changes will not be complete, the November 1, 2004 date only applies to non-ABI entries.)

Highlights of ACS (ABI) System Rules for Diamond Certificate Numbers

The following are highlights of the ACS (ABI) system rules outlined in CBP's message:

HTS numbers that require diamond certificate number.The HTS numbers requiring a diamond certificate number are as follows: 7102.10.0000, 7102.21.1010, 7102.21.1020, 7102.21.3000, 7102.21.4000, and 7102.31.0000.

Permit indicator. The above tariff numbers that are subject to a diamond certificate requirement will have a permit indicator of '06.' The permit indicator for a tariff number is indicated in the tariff reference file identifier V2 (output, positions 75-76) record and the tariff query transaction W2 (output, positions 75-76).

Entry summary record location. The diamond certificate number will be transmitted in the entry summary identifier 52 record (EI) (Input) in the miscellaneous permit/license number field (positions 30-38).

In most situations, diamond certificate number will be 9-position alpha/numeric number. The diamond certificate will be a nine-position alpha/numeric number. However, there may be situations where the issued diamond certificate number may be fewer or greater than nine positions. (See CBP's administrative message for the applicable reporting rules for such situations.)

Certain warehouse entries, TIBs. The diamond certificate requirement will be optional for warehouse entry types '21' and '22,' and the diamond certificate should not be submitted for temporary importation bonds (TIBs) (entry type '23').

Diamond certificate will be displayed in Block 34 of CF 7501. The diamond certificate will be displayed in Block 34 of the CF 7501, next to the visa number field.

CBP to send future message when ACS changes are completed. CBP states that it is working to complete the above system changes, and that a future message will be sent to the trade to indicate when the ACS changes have been completed.
