CBP Announces 2004/2005 Caps for Certain CBTPA Knit Apparel
U.S. Customs and Border Protection (CBP) has posted to its Web site a notice announcing the 2004/2005 quantities of certain knit apparel, described below, that are eligible to receive duty-free treatment under the U.S.-Caribbean Basin Trade Partnership Act (CBTPA) pursuant to HTS 9820.11.09 and 9820.11.12.

For the October 1, 2004 through September 30, 2005 period, CBP states that the capsfor certain knit apparel eligible to receive CBTPA duty-free treatment are as follows:

1 In its notice, CBP refers to "(U.S. fabric)" for certain HTS numbers. BP is checking with sources to determine the applicability of this reference.

- As of September 24, 2004, the 2003/2004 CBTPA cap for HTS 9820.11.09 (which ends September 30, 2004) was 44.63% filled and not estimated to close early.
The 2003/2004 CBTPA cap for HTS 9820.11.12 filled on August 3, 2004, thus closing early. (See ITT's Online Archives or 08/10/04 news, 04081010, for BP summary.)
- According to U.S. Note 2(b) and (c) in HTS Subchapter XX, the CBTPA cap for HTS 9820.11.09 has been increased to 970,000,000 SME for 2004/2005 from 850,000,000 SME in 2003/2004.
