CBP Administrative Messages, Electronic Bulletin Board Notices, Etc
U.S. Customs and Border Protection (CBP) has issued an administrative message stating that Phase 3 of the FDA BTA will be implemented on June 4, 2004, with full ABI edits turned on at or about 6:00 a.m. EDT on that date.

1. Full ABI Edits for Phase 3 of Bioterrorism Act Implementation Will be Turned on June 4, 2004
CBP states that failure to submit required prior notice data in Phase 3 will result in ABI rejection of the EI, HI, or HN application transactions, and filers will be expected to resubmit with the correct data.
During Phases 1 and 2 this failure to submit required prior notice data resulted only in a warning message.

2. Textile and Apparel Quotas 85% or More Filled as of June 1, 2004
CBP has posted to its Web site its "critical list" of textiles and apparel subject to import quotas with entered quantities 85% or more filled as of June 1, 2004. CBP states that this "critical list" may be used by CBP as a reference for releasing quota merchandise "off line" when the Automated Commercial System (ACS) is down for longer than four hours. CBP notes that textile and apparel merchandise for Electronic Visa Information System (ELVIS) countries cannot be released "off line" until it is processed through quota. CBP further notes that if the system is down for more than 24 hours, Headquarters Quota Branch should be contacted for further instructions. CBP also states that merchandise subject to tariff-rate quotas (TRQs), which are filled, may be released if entered under the "over quota" (high) rate of duty. 3. Weekly Quota Commodity Report as of June 2, 2004
CBP has issued its weekly quota commodity report as of June 2, 2004. This report includes tariff-rate quotas (TRQs) on various products such as beef, tuna, sugar, dairy products, peanuts, cotton, cocoa powder, tobacco, certain JFTA, NAFTA, SFTA, and UCFTA TRQs, etc. This report also includes the AGOA, ATPDEA, CBTPA, NAFTA, SFTA, and UCFTA tariff preference levels (TPLs) for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics under HTS 9902.51.11 & 9902.51.12, etc. (CBP's weekly quota commodity report dated 06/02/04, available at http://www.cbp.gov/xp/cgov/import/textiles_and_quotas/commodity/)
4. Joint CBP/ICE Intellectual Property Rights Symposium Canceled
CBP has posted to its Web site a notice announcing that it canceled the CBP and U.S. Immigration and Customs Enforcement (ICE) 2004 Intellectual Property Rights (IPR) Symposium that was scheduled for May 25, 2004.
CBP notes that the Interpol and World Customs Organization's (WCO's) First Global Congress on Combating Counterfeiting was to be held in Brussels on May 25-26, 2004 and the outcome of this very high profile event will complement any IPR Symposium that CBP would hope to conduct in the future. Therefore, CBP states that it was appropriate to delay the joint CBP/ICE IPR Symposium until further notice.
