Broker Power's List of 2004 Duty Rates for 70% or More Silk Woven Apparel

Broker Power has listed the 2004 general (column 1) duty rates for certain woven apparel that is 70% or more by weight silk or silk waste and is subject to a silk category number (7XX).

Clients should note that there are currently no visa or quota requirements for 70% or more silk textiles and apparel from any country, and none are expected to be established.

(This list is not intended to be a comprehensive listing of duty rates, nor is this a classification guide. Also, for ease of reference, whenever the term "silk" is used below it means "70% or more silk or silk waste.")

Notes and Disclaimers for Woven Apparel List

Duty rates for additional apparel items:

Men's and boys' shirts in Cat 740 that are excluded from HS 6205 due to being sleeveless, or having the characteristics of wind jackets (which generally have a tightening at the bottom), or jackets (which generally have pockets below the waist) have a duty rate of 0.5%.

Similarly, women's and girls' blouses, shirts, shirt-blouses, sleeveless tank styles, and similar upper body garments in Cat 741 that are excluded from HS 6206 have a duty rate of 1.2%.

Men's and boys' jackets and jacket-type garments in Cat 734 that are excluded from HS 6201 have a duty rate of 0.5%.

Women's and girls' jackets and jacket-type garments in Cat 735 that are excluded from HS 6202 have a duty rate of 1.2%.

In addition, babies garments containing 70% or more by weight silk or silk waste are listed as category-free and have a Free rate of duty.

Clients should note that this listing excludes the general (column 1) duty rates for:

  • garments that are 'subject to restraints,'
  • the basket category 759, other than jumpers, vests imported separately, and washsuits, sunsuits, and one-piece playsuits (for example, swimwear and overalls are excluded from the listing),
  • articles imported as parts of ensembles, or imported as accessories (e.g. scarves, ties, gloves) or as apparel or accessory parts,
  • ski-suits and tracksuits (or articles imported as parts of ski-suits or track suits) in Cats 734, 735, 747, and 748,
  • Garments in cats 734, 735, 747, and 748 made up of fabrics of HS 5602, 5603, 5906, or 5907 that are classified in HS 6210.

As used in this listing, the term:

Overcoats includes carcoats, capes, cloaks, and similar coats.

Anoraks includes ski jackets, wind breakers and similar articles.

This listing for 70% or more silk woven apparel should not be used as a classification guide.

Classification of an apparel item should be done by examining the HS Tariff Schedule, Explanatory Notes and/or earlier rulings and/or by making a binding ruling request. In addition, an expert knowledgeable in the classification field can be helpful in this endeavor.
